1. Acceptance of Terms

By accessing or using SidelineRecruiter ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SidelineRecruiter is a platform that connects athletes with college coaches and helps users track their recruiting journey, manage events, and coordinate team activities. The Service includes features for event management, coach attendance tracking, team collaboration, and coach directory access.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Types

The Service offers different account types with varying levels of access. Your access level is determined by your role (athlete, coach, team manager, parent, etc.) and team memberships.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate any third-party rights, including intellectual property rights
  • Transmit any harmful code, viruses, or malicious software
  • Attempt to gain unauthorized access to the Service or other accounts
  • Interfere with or disrupt the Service or servers
  • Harass, abuse, or harm other users
  • Collect or store personal data about other users without permission
  • Use automated systems to access the Service without authorization
  • Impersonate any person or entity
  • Post false, misleading, or defamatory content

5. User Content

5.1 Ownership

You retain ownership of any content you create, upload, or post on the Service ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to post User Content and that it does not violate any third-party rights or applicable laws.

6. Team Collaboration

The Service allows users to collaborate within teams. By joining a team or accepting a team invitation:

  • You agree to share certain information with team members
  • Team managers and coaches may have additional permissions
  • You are responsible for maintaining appropriate boundaries and respecting other team members' privacy
  • Team administrators may remove you from a team at their discretion

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SidelineRecruiter and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible for any damage or loss caused by your use of any third-party service.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by deleting it through your account settings.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless SidelineRecruiter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which SidelineRecruiter operates, without regard to its conflict of law provisions.
